LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 78TH LEGISLATIVE REGULAR SESSION

February 12, 2003

TO:
Honorable Frank Madla, Chair, Senate Committee on Intergovernmental Relations

FROM:
John Keel, Director, Legislative Budget Board

IN RE:
SB391 by Harris (Relating to the operation of a jail commissary by a sheriff in certain counties.), As Introduced

No fiscal implication to the State is anticipated.

The bill would amend the Local Government Code to change the population parameter from 300,000 or more to 200,000 or more for the size of two municipalities within a county of one million or more in determining in which county jail a jail commissary may be operated by a sheriff. The bill would take effect September 1, 2003.

Current statute applies only to Tarrant County; the change in population size would add Dallas County to the counties to which the statute applies.

Local Government Impact

Because the bill would not have statewide impact on units of local government of the same type or class, no comment from this office is required by the rules of the House/Senate as to its probable fiscal implication on units of local government.
