FISCAL NOTE, 78TH LEGISLATIVE REGULAR SESSION

March 20, 2003

TO:
Honorable Robert Duncan, Chair, Senate Committee on Jurisprudence

FROM:
John Keel, Director, Legislative Budget Board

IN RE:
SB430 by Hinojosa (Relating to the availability of a legislative continuance in a judicial matter.), Committee Report 1st House, Substituted

No fiscal implication to the State is anticipated.

The bill would amend the Civil Practice and Remedies Code, Section 30.003 to make a legislative continuance available to a member-elect of the legislature.  The continuance would be discretionary with the court if the member-elect is an attorney in a criminal case and was employed on or after the 15th day before the date on which the suit is set for trial. The bill would take immediate effect if it receives a two-thirds vote of all the members elected to each house. Otherwise, the bill would take effect September 1, 2003.

Local Government Impact

No fiscal implication to units of local government is anticipated.
