TO: | Honorable John Whitmire, Chair, Senate Committee on Criminal Justice |
FROM: | John Keel, Director, Legislative Budget Board |
IN RE: | SB433 by Nelson (Relating to the issuance and enforcement of protective orders to protect victims of sexual assault; providing criminal penalties.), Committee Report 1st House, Substituted |
The bill would amend the Code of Criminal Procedure concerning the issuance and enforcement of protective orders for victims of sexual assault and aggravated sexual assault. A violation of a protective order issued on the basis of sexual assault would be punishable as a Class A misdemeanor. The bill would also amend the Code of Criminal Procedure by allowing any peace officer to arrest, without warrant persons who the officer has probable cause to believe have committed the offense of violation of protective order. It is assumed that the bill would not significantly affect the operations of state or local government.
