SB611 by Nelson (relating to printing a social security number on an identification card or other identification device; providing a civil penalty. ), Committee Report 2nd House, As Amended

No significant fiscal implication to the State is anticipated.

The bill would amend the Business & Commerce Code by adding Section 35.58 to prohibit a person from printing an individual's Social Security number on a card or device required to access a product or service provided by the person. The bill would create a civil offense, with a penalty not to exceed $500 per violation, for persons who violated the prohibition and would provide for certain exemptions from the prohibition. The bill would allow the Attorney General or a county prosecuting attorney to bring action to recover the civil penalty and bring action to restrain or enjoin a person from violating the prohibition. The bill would become effective March 1, 2005 for cards or devices issued in conjunction with insurance policies delivered, issued for delivery, or renewed on or after March 1, 2005.

Local Government Impact

No fiscal implication to units of local government is anticipated due to the small number of anticipated cases.
