The bill would make no appropriation but could provide the legal basis for an appropriation of funds to implement the provisions of the bill.

Fiscal Analysis

This bill would amend the Code of Criminal Procedure to implement a $2.50 court cost on felony and misdemeanor convictions. The court clerk would remit the court costs to the Comptroller after deducting a 10 percent timely remittance collection fee. The Comptroller would credit 20 percent of the revenue to the Center for Transportation Safety at Texas A&M University and the remainder to the Department of Public Safety.


Methodology

Estimates of the increased revenues from the new court cost were based on estimated court cost revenue data from the 2004-05 Biennial Revenue Estimate, adjusted for offenses committed and adjudicated after the effective date and deducting the 10 percent administration fee that would be retained by local governments. Revenues to local governments were based on the 10 percent collection fee for timely remittal to the Comptroller.

Local Government Impact

Local units of government would have a corresponding positive fiscal impact (revenue gain) from the additional court cost on felony and misdemeanor convictions for timely remittance to the state Comptoller.  Estimated revenue to local government is $392,000 in FY 2004, $2,086,000 in FY 2005, $2,306,000 in FY 2006, $2,548,000 in FY 2007, and $2,816,000 in FY 2008.
