SB825 by Whitmire (Relating to the prosecution of the offense of sexual assault committed against residents of certain facilities. ), Committee Report 1st House, Substituted

No significant fiscal implication to the State is anticipated.

The bill would amend the Penal Code by including the employee of a facility having nonconsensual sex with persons residing in those facilities as behavior covered by the offense of sexual assault.  The bill would also add an exception to prosecution for the offense of sexual assault.   It is assumed that the number of additional offenders convicted under this statute would not result in a significant impact on the programs and workload of state corrections agencies or on the demand for resources and services of those agencies.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
