No significant fiscal implication to the State is anticipated.
The bill would amend Section 250 of the Health and Safety Code to require a nursing facility to conduct a criminal history check on each licensed employee or applicant for employment. The Department of Human Services indicated that the cost would be $37,326 in All Funds, $14,848 in General Revenue for fiscal year 2004 and $20,148 in All Funds, $8,015 in General Revenue each year there after. The cost of the criminal check is a Medicaid eligible expense and as such could be included in the provider rate structure.
