LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 78TH LEGISLATIVE REGULAR SESSION

April 7, 2003

TO:
Honorable John Whitmire, Chair, Senate Committee on Criminal Justice

FROM:
John Keel, Director, Legislative Budget Board

IN RE:
SB958 by Duncan (Relating to venue in the prosecution of the offenses of escape and unauthorized absence.), As Introduced

No significant fiscal implication to the State is anticipated.

Local Government Impact

No significant fiscal implication to units of local government is anticipated. Costs to counties to implement the bill would depend upon the number of escape or unauthorized absences recorded, the county from which a defendant escaped, and the county in which a defendant is apprehended.  Information from the Texas Department of Criminal Justice and the Texas District and County Attorney's Association indicates that the number of escapes or authorized absences recorded ranges from ten to twenty per fiscal year. The cost to county courts to prosecuting the offenders would be insignificant.
