There would be costs to municipalities only if they owned a solid waste landfill facility that is located 3,000 feet or less from at least one residence in a residential area containing at least 20 residences. Additionally, if a municipality receives a notice of violation and fails to abate the nuisance, the city would incur costs to respond to enforcement actions initiated by the Texas Commission on Environmental Quality.
The city of Dallas reported that the bill could require a misting system placed upwind of the residential area. Set-up costs for the system would be $10,000 for every 200 linear feet, plus $300 to $600 per month for the masking agent. Another requirement would be a gas collection and control system, which could cost approximately $15 million.
The city of Waco reported that the bill would require their landfill facilities to install additional piping, flares, and other equipment to burn off methane gas. The cost could run into the "thousands of dollars."
The city of reported that it does not own or operate a landfill but it does own three transfer stations which are operated by private contractors. These transfer stations may be required to install more equipment to control odors.
The cities of Big Spring, Carrollton, and Weatherford reported that implementing the provisions of the bill would not have a significant impact on their budgets.
