LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 78TH LEGISLATIVE REGULAR SESSION

March 29, 2003

TO:
Honorable Frank Madla, Chair, Senate Committee on Intergovernmental Relations

FROM:
John Keel, Director, Legislative Budget Board

IN RE:
SB1118 by Williams (Relating to notice sent by a local government after a mandatory pre-bid conference.), As Introduced

No fiscal implication to the State is anticipated.

The bill would authorize a local government, after conducting a pre-bid conference, to send any required notices by certified mail, return receipt requested, only to prospective bidders who attended the conference. The bill would take effect September 1, 2003 and apply only to a proposed purchase or contract awarded by a competitive purchasing procedure for which a mandatory pre-bid conference is held on or after that date.

Under current statute, notice of a proposed purchase or of seeking bids for a purchase or contract must be published in a newspaper of general circulation at least once a week for two consecutive weeks. If a local government entity has held a pre-bid conference, there would be a savings associated with not having to publish notice in a newspaper. The cost of sending notice by certified mail to only the participants of the conference is anticipated to be less than the cost of publication by newspaper, although the savings would not be significant compared to a local government's overall budget.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
