No fiscal implication to the State is anticipated.

The bill would authorize the governing body of a political subdivision for which a candidate seeks office to declare a candidate elected if the candidate is the only person who has qualified to appear on the ballot for that office and if there are no names on a list of write-in candidates if write-in candidates are allowed only from a list in that election.  Procedures for declaring the candidate as elected are provided in the proposed statute.

The bill would take effect on the date on which the constitutional amendment proposed by the Seventy-eighth Legislature, Regular Session, 2003, authorizing the legislature to permit a person to assume an office of a political subdivision without an election in the circumstances described would take effect. If the proposed constitutional amendment is not approved, the bill would have no effect.
