LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 78TH LEGISLATIVE REGULAR SESSION

May 7, 2003

TO:
Honorable Jaime Capelo, Chair, House Committee on Public Health

FROM:
John Keel, Director, Legislative Budget Board

IN RE:
SB1226 by Nelson (Relating to the allocation of kidneys available for transplant in this state.), As Engrossed

No significant fiscal implication to the State is anticipated.

The bill, as substituted, would remove the requirement that the Department of Health develop rules for the establishment of two patient pools and an organ sharing pool for the purpose of allocating kidneys for transplant in Texas, to the extent allowed by federal law. The bill would provide that the use of the pools would be managed by the federal Organ Procurement and Transplant Network.

The Department of Health indicates that the implementation of the provisions of the bill would have no significant fiscal impact on the agency or public health.

Local Government Impact

No fiscal implication to units of local government is anticipated.
