No fiscal implication to the State is anticipated.

The bill would amend the Water Code as it relates to port authorities' and navigation districts' powers regarding surface leases, sale and lease of land, and contracts, including for emergency purchases. The bill would take effect immediately if it receives a two-thirds vote in each house; otherwise, it would take effect September 1, 2003 and would apply only to contracts entered into on or after that date and to leases entered into before, on, or after that date.

 

Port authorities and navigation districts were contacted regarding the fiscal impact of the bill. The Port of Houston Authority (PHA) is the only authority that responded. PHA stated that there would be a positive fiscal impact (savings and revenue gains) from implementation of the provisions of the bill, although the impact would be insignificant in comparison to the overall budget of the PHA.


Local Government Impact

No significant fiscal implication to units of local government is anticipated.
