May 22, 2003

TO:
Honorable Robert Puente, Chair, House Committee on Natural Resources

FROM:

IN RE:
SB1302 by Madla (Relating to adding land that is in the extraterritorial jurisdiction of a municipality to the territory of certain special purpose districts. ), Committee Report 2nd House, As Amended

No fiscal implication to the State is anticipated.

The bill would establish procedures required when a political subdivision that supplies fresh water for domestic or commercial use or to furnish sanitary sewer services, roadways, or drainage, seeks to add territory to its jurisdiction if the territory is in the extraterritorial jurisdiction (ETJ) of a municipality. The provisions of the bill would not apply in any part of the ETJ for which a water and wastewater utility owned by the municipality has been issued a certificate of convenience and necessity by the Texas Commission on Environmental Quality to supply water and sanitary sewer services.

The bill would take effect September 1, 2003.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
