The bill would amend and add new sections to Chapter 166 of the Health and Safety Code relating to advanced directives for medical treatment. The bill would establish procedures to follow in the event that a physician disagrees with patient-established advanced directives. The bill would allow a licensed nurse or person providing health care services in an out-of-hospital setting to honor a physician’s do not resuscitate order. The bill would also authorize emergency medical services personnel to honor only a properly executed or issued out-of-hospital do not resuscitate order or prescribed do not resuscitate identification device.
No significant fiscal impact is anticipated to the state because the Texas Department of Health indicates it could revise existing rules to implement the provisions of this bill with existing staff resources.
