LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 78TH LEGISLATIVE REGULAR SESSION

April 28, 2003

TO:
Honorable Jane Nelson, Chair, Senate Committee on Health & Human Services

FROM:
John Keel, Director, Legislative Budget Board

IN RE:
SB1320 by Nelson (Relating to certain advance directives for medical treatment and medical treatment decisions. ), Committee Report 1st House, Substituted

No significant fiscal implication to the State is anticipated.

This bill would amend and add new sections to Chapter 166 of the Health and Safety Code relating to advanced directives for medical treatment.  The bill would establish procedures to follow in the event that a physician disagrees with patient-established advanced directives.  The bill would allow a licensed nurse or person providing health care services in an out-of-hospital setting to honor a physician’s do not resuscitate order.  The bill would also authorize emergency medical services personnel to honor only a properly executed or issued out-of-hospital do not resuscitate order or prescribed do not resuscitate identification device.

No significant fiscal impact is anticipated to the state because the Texas Department of Health indicates it could revise existing rules to implement the provisions of this bill with existing staff resources.

This bill would take effect upon passage or September 1, 2003.

Local Government Impact

No fiscal implication to units of local government is anticipated.
