No fiscal implication to the State is anticipated.

The bill would amend Section 552.117 of the Government Code to exempt documents filed with a county clerk from having certain information excluded from disclosure. The bill would take effect immediately if it receives a two-thirds vote in each house; otherwise, it would take effect September 1, 2003.

Currently, certain employees of a governmental body, certain law enforcement officers, and employees of the Texas Department of Criminal Justice are exempt from having their home address and telephone number, Social Security number, or certain family information released to the public. Under the provisions of the bill, that information would no longer be exempt for those individuals if the documents were filed with a county clerk.

According to the County and District Clerk's Association of Texas, the bill would allow the county clerks to release documents intact without having to review them for excluded information such as certain addresses, telephone numbers, Social Security numbers, and personal family information of persons identified in Section 552.117 of the Government Code.
