No significant fiscal implication to the State is anticipated.

The bill would amend the Civil Practices and Remedies Code to relieve a highway contractor of liability for torts arising from construction or repairs to a highway, road, or street for the Department of Transportation, if the contractor was in compliance with specifications identified in the bill.

 

Based on the analysis of the Department of Transportation, it is assumed that duties and responsibilities associated with implementing the provisions of the bill could be accomplished by utilizing existing resources and that the provisions of the bill would have no significant fiscal impact to the state.

 

The bill would take effect September 1, 2003, and would only apply to a cause of action that would accrue on or after that date.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
