No significant fiscal implication to the State is anticipated.

The bill would amend sections of Chapter 37, Education Code. In addition to a number of technical and non-substantive amendments, the bill would make changes to provisions governing special education students and amends provisions governing placement in alternative placements, including Juvenile Justice Alternative Education Programs (JJAEP's).

Both the Juvenile Probation Commission and the Texas Education Agency estimate that an insignificant number of students would be added to the JJAEP system as a result of the the new offenses included in the bill. However, TJPC estimates that three counties do not currently meet the requirements of Section 9 of the bill, the cost for those three counties to come into compliance is estimated to be $1.8 million for the 2004-2005 biennium.

JJAEP's are funded as a set-aside from the Foundation School Program at the Texas Education Agency. The use of this funding mechanism is neutral to the state, although it has implications to local school districts and to the impacted state agencies.

For the purposes of this estimate, it is assumed that the current means of funding the JJAEP’s would continue and if necessary would increase. Thus, these provisions do not have a significant fiscal impact.

No significant fiscal implication to units of local government is anticipated.
