SB1566 by Madla (Relating to certain mass gatherings; providing certain criminal and civil penalties. ), Committee Report 2nd House, As Amended

No fiscal implication to the State is anticipated.

The bill would amend the Health and Safety Code to change the definition of mass gathering and as the code relates to the procedures for obtaining a permit to hold certain gatherings. The bill would also amend the Local Government Code as it relates to obtaining permits for holding events in certain facilities.

Provisions of the bill would establish criminal penalties for various violations of mass gathering regulations, and civil penalties that would be payable to the political subdivision in which the mass gathering is held or poroposed to be held.

The bill would take effect September 1, 2003 and apply only to a permit for which an application is filed on or after that date and to an offense committed on or after that date.

The additional procedures would affect the county health authority, county fire marshal, county sheriff, county judge, and municipalities. Responses from a sampling of each indicated that there would be no significant fiscal impact.

No significant fiscal implication to units of local government is anticipated.
