LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 78TH LEGISLATIVE REGULAR SESSION

April 29, 2003

TO:
Honorable John Whitmire, Chair, Senate Committee on Criminal Justice

FROM:
John Keel, Director, Legislative Budget Board

IN RE:
SB1593 by West (Relating to good conduct time earned by certain inmates.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would amend the Government Code by further defining good conduct time accrual policies.  The bill would allow an inmate who participates in certain programs to receive 45 days good conduct time on successful completion of certain programs.  This provision is likely to result in a decrease in the inmate population depending on the number of inmates that complete the program, and on the number of those inmates that are approved for parole and for mandatory supervision release.

The bill would also provide that certain inmates are not precluded from participation in certain programs for reasons specified in the bill.  The bill would also make inmates ineligible for participation in certain programs if on one more than one occasion participation in the program by the inmate were unsuccessful because of a disciplinary infraction committed by the inmate.  The Texas Department of Criminal Justice anticipates no fiscal impact from this provision of the bill.

Local Government Impact

No fiscal implication to units of local government is anticipated.
