SB1811 by Whitmire (Relating to service of process of a sports and community venue district located in a populous county.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would authorize that a sports and community venue district located in a populous county may sue and be sued in any court of this state.

According to analysis by the Office of Court Administration (OCA), the fiscal impact on the state court system would be insignificant. The OCA also anticipates that there would be no fiscal impact on the local court system.

A sports and community venue district in a populous county would incur legal costs if it were to exercise the authority to file a lawsuit, although if it were to win the suit, legal costs would be recouped. If, however, a district were to lose a lawsuit it files or were to be sued and were to lose, the costs would be significant. (Note: The affected section of the Local Government Code does not define "populous county.")


Local Government Impact

No fiscal impact to the local court system is anticipated. There is a potential of a significant fiscal impact on a sports and commuity venue district in a populous county if it sues or is sued.
