LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 78TH LEGISLATIVE REGULAR SESSION

April 30, 2003

TO:
Honorable Frank Madla, Chair, Senate Committee on Intergovernmental Relations

FROM:
John Keel, Director, Legislative Budget Board

IN RE:
SB1811 by Whitmire (Relating to service of process of a sports and community venue district located in a populous county.), Committee Report 1st House, Substituted

No significant fiscal implication to the State is anticipated.

The bill would add Section 335.005 to the Local Government Code to authorize that a sports and community venue district located in a populous county may sue and be sued in any court of this state.

According to analysis by the Office of Court Administration (OCA), the fiscal impact on the state court system would be insignificant. The OCA also anticipates that there would be no fiscal impact on the local court system.

As per Section 335.035, Local Government Code, a populous county is a county with a population of 2.4 million or more; therefore, provisions of the bill would apply only to Harris County.

Local Government Impact

Because the bill would not have statewide impact on units of local government of the same type or class, no comment from this office is required by the rules of the House/Senate as to its probable fiscal implication on units of local government.
