No significant fiscal implication to the State is anticipated.
The bill would amend the Code of Criminal Procedure by requiring an arrested person who causes an officer to come in contact with the person’s bodily fluids to undergo a test designed to show whether the person has a communicable disease, at the direction of the court having jurisdiction over the arrested person.The Code of Criminal Procedure currently allows for such testing in cases where persons are arrested for the offense of resisting arrest, search, or transportation.It is assumed that the bill would not have a significant impact on the State.
