Fiscal Analysis

The bill would amend the Transportation Code as it relates to the eligibility of a person to operate a commercial motor vehicle in the state by expanding the definition of a "serious traffic violation" to include violations that have occurred in any motor vehicle, not just a commercial vehicle, when determining qualifications for obtaining and keeping a commercial drivers license.  Furthermore, the bill places the state in compliance with federal Motor Carrier Safety Improvement Act and prevents the loss of federal highway funds in FY 2006, FY 2007 and FY 2008.

Methodology

The bill would prevent the loss of Federal-Aid Highway funds for operating a federal noncompliant commercial driver license program.  FY 2006 represents a five percent gain of total Federal-Aid Highway funds and FY 2007 and FY 2008 represent a 10 percent gain in Federal-Aid Highway funds.


Local Government Impact

No significant fiscal implication to units of local government is anticipated.  Local government entities may incur minimal costs to report offenses to the Texas Department of Public Safety.
