LEGISLATIVE BUDGET BOARD
Austin, Texas

CRIMINAL JUSTICE IMPACT STATEMENT

78TH LEGISLATIVE REGULAR SESSION

February 24, 2003

TO:
Honorable Mary Denny, Chair, House Committee on Elections

FROM:
John Keel, Director, Legislative Budget Board

IN RE:
HB403 by Madden (Relating to the penalty for premature disclosure of voting results.), As Introduced

The bill would amend the Election Code by enhancing the punishment for unlawfully revealing information before polls close from a Class C misdemeanor to a Class A misdemeanor.

A Class C misdemeanor is punishable by a fine not to exceed $500.

A Class A misdemeanor is punishable by confinement in county jail for a term not to exceed one year, a fine not to exceed $4,000, or both fine and imprisonment.

In the case of this bill, the increased workload from enhancing the punishment for unlawfully revealing information before polls close would probably not be substantial according to analysis provided by the Secretary of State and the Office of the Attorney General.
