LEGISLATIVE BUDGET BOARD
Austin, Texas

CRIMINAL JUSTICE IMPACT STATEMENT

78TH LEGISLATIVE REGULAR SESSION

April 12, 2003

TO:
Honorable Terry Keel, Chair, House Committee on Criminal Jurisprudence

FROM:
John Keel, Director, Legislative Budget Board

IN RE:
HB420 by Martinez Fischer (Relating to the punishment for theft committed against elderly individuals.), As Introduced

The bill would amend the Penal Code by defining an elderly individual as a person 65 year of age or older in the provision of the Penal Code related to the enhancement for the punishment of the offense of theft.

Punishment for the offense of theft ranges from a Class C misdemeanor to a felony of the first degree depending on the amount, and type, of property stolen.

It is assumed that the number of offenders convicted under this statute would not result in a significant impact on the programs and workload of state corrections agencies or on the demand for resources and services of those agencies.
