LEGISLATIVE BUDGET BOARD
Austin, Texas

CRIMINAL JUSTICE IMPACT STATEMENT

78TH LEGISLATIVE REGULAR SESSION

April 16, 2003

TO:
Honorable Kenny Marchant, Chair, House Committee on State Affairs

FROM:
John Keel, Director, Legislative Budget Board

IN RE:
HB432 by Bonnen (Relating to the creation of an offense involving certain sales of tickets to certain events; providing a penalty.), Committee Report 1st House, Substituted

The bill would amend the Business & Commerce Code by creating the offense of ticket scalping which would prevent the resell or offer to resell a ticket to a livestock show or rodeo sponsored by a nonprofit organization for a price more than $10 more than the price authorized to be offered to the public by the nonprofit organization.  Punishment for the offense would range from a misdemeanor punishable by a find not to exceed $100 to a misdemeanor punishable by a fine not to exceed $5,000, depending on the number of previous convictions for the offense.

It is assumed that the number of offenders convicted under this statute would not result in a significant impact on the programs and workload of state corrections agencies or on the demand for resources and services of those agencies.
