HB432 by Bonnen (Relating to the creation of an offense involving certain sales of tickets to events; providing a penalty.), As Introduced

The bill would amend the Business & Commerce Code by creating the offense of ticket scalping which would prevent the resell or offer to resell a ticket to an event for a price that is more than $5 over the price authorized to be offered to the public by the event sponsor.  Punishment for the offense would range from a Class C misdemeanor to a state jail felony depending on the number of tickets sold or offered for sale.  If the number of tickets sold or offered for sale is 20 or more, the offense would be punishable as a state jail felony.

 

A state jail felony is punishable by confinement in a state jail for any term of not more than two years or less than 180 days, or, in addition to confinement, a fine not to exceed $10,000.

 

It is assumed that the number of offenders convicted under this statute would not result in a significant impact on the programs and workload of state corrections agencies or on the demand for resources and services of those agencies.
