LEGISLATIVE BUDGET BOARD

CRIMINAL JUSTICE IMPACT STATEMENT

78TH LEGISLATIVE REGULAR SESSION

April 14, 2003

TO:
Honorable Terry Keel, Chair, House Committee on Criminal Jurisprudence

FROM:
John Keel, Director, Legislative Budget Board

IN RE:
HB512 by Cook, Robby (Relating to the punishment for the offense of terroristic threat.), Committee Report 1st House, Substituted

The bill would amend the Penal Code by enhancing the punishment for the offense of terroristic threat from a Class B misdemeanor to a Class A misdemeanor if the offense is committed against a member of the person's family or household or against a public servant.

A Class A misdemeanor is punishable by confinement in county jail for a term not to exceed one year, a fine not to exceed $4,000, or both fine and imprisonment.

It is assumed that the bill would not significantly affect the operations of state or local government.
