HB565 by Haggerty (Relating to the punishments for the offenses of assault and aggravated assault committed against a security officer.), Committee Report 1st House, Substituted

The bill would amend the Penal Code by making the offense of assault punishable as a felony of the third degree if the offense is committed against a commissioned security officer while the officer is performing a duty as a security officer.  The bill would also make the offense of aggravated assault committed against a commissioned security officer while the officer is performing a duty as a security officer punishable as a felony of the first degree. 

A third degree felony is punishable by imprisonment in the institutional division for any term of not more than 10 years or less than 2 years, or, in addition to confinement, a fine not to exceed $10,000.

A second degree felony is punishable by imprisonment in the institutional division for any term of not more than 20 years or less than 2 years, or, in addition to confinement, a fine not to exceed $10,000.

A first degree felony is punishable by imprisonment in the institutional division for life or for any term of not more than 99 years or less than 5 years, or in addition to imprisonment, a fine not to exceed $10,000.

Since the punishment enhancement provisions of the bill would only apply to specific offenses committed against a commissioned security officer while the officers is performing a duty as a security officer, the impact of the enhancement provisions of the bill are not anticipated to be significant.
