HB729 by Goodman (Relating to the adoption of the Uniform Parentage Act regarding gestational agreements; providing penalties.), As Introduced

The provision of the bill that is the subject of this analysis would amend the Family Code by making the knowing or intentional payment to a prospective gestational mother with the intent to influence to enter into a gestational agreement punishable as a Class A misdemeanor.  The bill would also make certain types of advertising related to gestational mothering punishable as a Class A misdemeanor. 

 

A Class A misdemeanor is punishable by confinement in county jail for a term not to exceed one year, a fine not to exceed $4,000, or both fine and imprisonment.

 

For this analysis it is assumed that the number of offenders convicted under this statute would not result in a significant impact on the programs and workload of state corrections agencies or on the demand for resources and services of those agencies.
