HB819 by Isett (Relating to the prosecution of the offense of unlawfully carrying a handgun, illegal knife, or club.), As Introduced

The bill would amend the Penal Code by providing exceptions to the prosecution of individuals for the offense of unlawful carrying weapons.  The offense of unlawful carrying weapons is punishable as a Class A misdemeanor or a felony of the third degree, depending on the premises where the offense takes place. 

 

A Class A misdemeanor is punishable by confinement in county jail for a term not to exceed one year, a fine not to exceed $4,000, or both fine and imprisonment.

A third degree felony is punishable by imprisonment in the institutional division for any term of not more than 10 years or less than 2 years, or, in addition to confinement, a fine not to exceed $10,000.

Providing exceptions to the prosecution of individuals for offenses would result in fewer prosecutions and would not result in additional fiscal implications to the State.
