HB864 by Kolkhorst (Relating to prohibiting the introduction or possession of certain items in correctional facilities or on certain property of the Texas Department of Criminal Justice; providing penalties.), As Introduced

The bill would amend the Penal Code by adding to the items that cannot be provided to an inmate of a correctional facility.  The offense of prohibited substances in correctional facility or on property of Texas Department of Criminal Justice would be amended to exclude the providing of deadly weapons, cellular phones, and money to inmates.  The offense of prohibited substances in correctional facility or on property of Texas Department of Criminal Justice is punishable as a felony of the third degree. 

 

A third degree felony is punishable by imprisonment in the institutional division for any term of not more than 10 years or less than 2 years, or, in addition to confinement, a fine not to exceed $10,000.

 

The Texas Department of Criminal Justice anticipates no significant fiscal impact from this bill.
