HB1043 by Dukes (Relating to the punishment for certain defendants convicted of indecency with a child.), As Introduced

The bill would amend the Penal Code by including in the penalties for repeat and habitual felony offenders provision, the offenses of indecency with a child and sexual assault.  Persons convicted of an offense for indecency with a child and sexual assault with the requisite prior convictions would be punished by imprisonment in the institutional division for life.  The offense of indecency with a child is punishable as a felony of the third degree or a felony of the second degree.  The offense of sexual assault is punishable as a felony of the second degree. 

 

A second degree felony is punishable by imprisonment in the institutional division for any term of not more than 20 years or less than 2 years, or, in addition to confinement, a fine not to exceed $10,000.

A third degree felony is punishable by imprisonment in the institutional division for any term of not more than 10 years or less than 2 years, or, in addition to confinement, a fine not to exceed $10,000.

Under current law and policy, and under the proposed bill, the average time served in prison by persons likely to be affected by the provisions of this bill is greater than five years.  Therefore, no additional impacts on demands on the adult corrections agencies are anticipated during the first five years following passage of this bill.
