HB1218 by Chisum (relating to the continuation and functions of the Texas State Board of Public Accountancy; providing penalties. ), Committee Report 1st House, Substituted

The provision of the bill that is the subject of this analysis would amend the other penalties and enforcement provisions subchapter of the Occupations Code by assigning criminal penalties of:

(1)    a felony of the third degree if it is shown on the trial of the offense that the violation resulted in a monetary loss of less than $10,000 or did not result in a monetary loss; 

(2)    a felony of the second degree if it is shown on the trial of the offense that the violation resulted in a monetary loss of at least $10,000 but less than $100,000; and

(3)    a felony of the first degree if it shown on the trial of the offense that the violation resulted in a monetary loss of at least $100,000. 

 

It is assumed that the number of offenders convicted under this statute would not result in a significant impact on the programs and workload of state corrections agencies or on the demand for resources and services of those agencies.
