TO: | Honorable Joe Driver, Chair, House Committee on Law Enforcement |
FROM: | John Keel, Director, Legislative Budget Board |
IN RE: | HB1368 by McReynolds (Relating to the prosecution and punishment of the offense of making a false report to a peace officer or law enforcement employee.), As Introduced |
The bill would amend the Penal Code by making the offense of false report to a peace officer or a law enforcement employee punishable as a state jail felony if certain conditions are met. The offense of false report to a peace officer or a law enforcement employee is currently punishable as a Class B misdemeanor.
A state jail felony is punishable by confinement in a state jail for any term of not more than two years or less than 180 days, or, in addition to confinement, a fine not to exceed $10,000.
No significant impact on the programs and workload of state corrections agencies or on the demand for resources and services of those agencies is anticipated from this bill.
