The bill would include in the sentences for offenses arising out of the same criminal episode provision of the Penal Code the offense of intoxication assault.  The bill would allow sentences to run concurrently or consecutively for convictions of intoxication assault.  The offense of intoxication assault is punishable as a felony of the third degree. 

A third degree felony is punishable by imprisonment in the institutional division for any term of not more than 10 years or less than 2 years, or, in addition to confinement, a fine not to exceed $10,000.

The impact of the bill would depend on the extent to which intoxication assault convictions arising out of the same criminal episode would be required to serve consecutive sentences rather than concurrent sentences.  However, it is assumed that the additional number of offenders convicted under this statute would not result in a significant impact on the programs and workload of state corrections agencies or on the demand for resources and services of those agencies.
