HB2892 by Allen (Relating to a person knowingly bartering or expending funds derived from the commission of an offense, providing penalties.), As Introduced

The bill would amend the Health and Safety Code by including in the offense of illegal expenditure or investment the expenditure of funds or bartering of property the person knows are derived from the commission of an offense.  The offense of illegal expenditure or investment is punishable as a felony of the first degree.  The provisions proposed in the bill would be punishable as felonies of the second degree. 

A first degree felony is punishable by imprisonment in the institutional division for life or for any term of not more than 99 years or less than 5 years, or in addition to imprisonment, a fine not to exceed $10,000.

A second degree felony is punishable by imprisonment in the institutional division for any term of not more than 20 years or less than 2 years, or, in addition to confinement, a fine not to exceed $10,000.

The Texas Commission on Alcohol and Drug Abuse anticipates no significant fiscal implication to the State from the provisions of the bill.
