LEGISLATIVE BUDGET BOARD
Austin, Texas

OPEN GOVERNMENT IMPACT STATEMENT

78TH LEGISLATIVE REGULAR SESSION

February 13, 2003

TO:
Honorable Bill Ratliff, Chair, Senate Committee on State Affairs

FROM:
John Keel, Director, Legislative Budget Board

IN RE:
SB121 by Lindsay (Relating to the application of the open meetings law to certain health maintenance organizations.), As Introduced

As a result of this bill there will be a restriction upon:

(1) the open meetings law, and
(2) the access to government information.

The bill would amend Section 551.085 of the Government Code by adding health maintenance organizations created under Section 281.0515 of the Health and Safety Code to the list of health care service providers that are not required to conduct an opening meeting. Health care service providers are not required to conduct an open meeting if the meeting concerns pricing or financial information related to a bid or negotiation for the arrangement of services or product lines and such disclosure would give an advantage to a competitor or if the meeting relates to a proposed new service or product line.
