OPEN GOVERNMENT IMPACT STATEMENT

78TH LEGISLATIVE REGULAR SESSION

March 22, 2003

TO:
Honorable Steve Ogden, Chair, Senate Committee on Infrastructure Development and Security

FROM:
John Keel, Director, Legislative Budget Board

IN RE:
SB764 by Lindsay (Relating to the application of the open meetings law and the public information law to meetings and information of certain governmental bodies relating to the security of a port in this state.), As Introduced

As a result of this bill there will be a restriction upon:

(1) the open records law;
(2) the open meetings law; and
(3) the access to government information.

A governmental body that governs a port would not be required to conduct an open meeting to deliberate on certain matters related to the security of the port. Information related to the security measures would be excepted from the requirements under Section 552.021 of the Government Code if such disclosure could jeopardize the security of the port.
