         Pursuant to a notice posted in accordance with Senate Rule  
         11.18, a public hearing of the Senate Committee on Business &  
         Commerce was held on Tuesday, February 25, 2003, in the Betty  
         King Committee Hearing Room, 2E.20, at Austin, Texas.

         Chairman Fraser called the meeting to order at 10:07 a.m.  There  
         being a quorum present, the following business was transacted:  
          
         Senator Averitt assumed the chair, laid out SB 129 and  
         recognized the author, Senator Fraser, to explain the bill.    
         The Chairman called the first invited witness to present his  
         testimony: 
          
              Kyle Dotson, Certified Industrial Hygienist, Houston,  
         Texas. 
          
         At 10:56 a.m. the Chairman moved that the committee stand  
         recessed until 15 minutes after adjournment of the Senate;  
         without objection, it was so ordered.   
          
         At 12:45 p.m. the committee reconvened, with Senator Fraser in  
         the chair.  The invited testimony continued with Ed Small,  
         representing the Indoor Air Quality Association Inc., Austin. 
          
         Claren Kotrla, Texas Department of Health, was called to respond  
         to members' question.  Invited testimony continued as follows:  
          
              Kathi Giaramita, ServiceMaster, Memphis, TN, and 
              Gregory Becker, TDH Mold Task Force, and Texas Association  
  
         of Indoor Air Quality, 
                   Houston. 
          
         Public testimony was presented by: 
          
              Todd McAuster, Texas Air Conditioning Contractors  
         Association, Austin, 
              Connie Heyer, Building Owners and Managers Association,  
         Austin, 
              David Mintz, Texas Apartment Association, Austin, and 
              Scott Norman, Texas Association of Builders, Austin. 
          
         Witnesses registering for the bill but not wishing to testify  
         are shown on the attached witness list.  The Chairman moved that  
         SB 129 be left pending; without objection, it was so ordered.   
          
         Senator Averitt assumed the chair, laid out SB 128 and  
         recognized the author, Senator Fraser, to explain the bill.   
         Witnesses testifying were as follows: 
          
              Jerry Edler, Independent Adjuster, San Antonio, 
              Leo Wadley, Fort Worth, 
              Jim Beneke, Public Adjuster, Austin, 
              Tim Sulak, Texas Trial Lawyers Association, Austin, and 
              Matt Ray, Texas Department of Insurance, Austin. 
          
         Witnesses registering for the bill but not wishing to testify  
         are shown on the attached witness list.  The Chairman moved that  
         SB 128 be left pending; without objection, it was so ordered.   
          
         There being no further business, at 3:05 p.m. the Chairman moved  
         that the Committee stand recessed subject to the call of the  
         chairman.  Without objection, it was so ordered.
