         Pursuant to a notice posted in accordance with Senate Rule  
         11.18, a public hearing of the Senate Committee on  
         Intergovernmental Relations was held on Wednesday, April 9,  
         2003, in the Capitol Extension, Room E1.028, at Austin, Texas.

         The chair called the meeting to order at 9:05 a.m.  There being  
         a quorum present, the following business was transacted:   
          
         Senator Brimer moved that the minutes from the 04/02/03 hearing  
         be approved; without objection it was so ordered. 
          
         The chair laid out SB 1765 and recognized the author, Senator  
         Deuell, to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list.  Senator  
         Deuell moved that SB 1765 be reported favorably to the Senate  
         with the recommendation that it do pass and be printed.  The  
         motion carried with a record vote of 4 ayes, 0 nay, 0 present  
         not voting, and 1 absent.  Senator Deuell moved that the bill be  
         recommended for placement on the Local & Uncontested Calendar;  
         without objection, it was so ordered.   
          
         The chair laid out SB 892 and recognized Senator Brimer, in the  
         absence of the author, to explain the bill.  Senator Brimer sent  
         up a committee substitute; the chair recognized Senator Brimer  
         to explain the difference between the committee substitute and  
         the bill as filed.  Senator Brimer moved adoption of the  
         committee substitute; without objection, it was so ordered.   
         Witnesses testifying and registering on the bill are shown on  
         the attached list.  Senator Brimer moved that SB 892 do not pass  
         but that CSSB 892 be reported back to the Senate with the  
         recommendation that it do pass and be printed.  The motion  
         carried with a record vote of 4 ayes, 0 nay, 0 present not  
         voting, and 1 absent.  Senator Brimer moved that the bill be  
  
         recommended for placement on the Local & Uncontested Calendar;  
         without objection, it was so ordered.   
          
         The chair laid out SB 1689 and recognized the author, Senator  
         Gallegos, Jr., to explain the bill.  Senator Gallegos, Jr. sent  
         up a committee substitute; the chair recognized Senator  
         Gallegos, Jr. to explain the difference between the committee  
         substitute and the bill as filed.  Senator Gallegos, Jr. moved  
         adoption of the committee substitute; without objection, it was

         that SB 1689 do not pass but that CSSB 1689 be reported back to  
         the Senate with the recommendation that it do pass and be

         moved that the bill be recommended for placement on the Local &  
         Uncontested Calendar; without objection, it was so ordered.   
          
         The chair laid out SB 726 and recognized the author, Senator  
         Wentworth, to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list.  Senator  
         Wentworth moved that SB 726 be reported favorably to the Senate  
         with the recommendation that it do pass and be printed.  The  
         motion carried with a record vote of 5 ayes, 0 nay, 0 present  
         not voting, and 0 absent.  Senator Wentworth moved that the bill  
         be recommended for placement on the Local & Uncontested  
         Calendar; without objection, it was so ordered.   
          
         The chair laid out SB 1696 and recognized the author, Senator  
         Wentworth, to explain the bill.  Senator Wentworth sent up a  
         committee substitute; the chair recognized Senator Wentworth to  
         explain the difference between the committee substitute and the  
         bill as filed.  Senator Wentworth moved adoption of the  
         committee substitute; without objection, it was so ordered.

         recommended for placement on the Local & Uncontested Calendar;  
         without objection, it was so ordered.   
          
         The chair laid out SB 1277 and recognized the author, Senator  
         Armbrister, to explain the bill.  Senator Madla moved that SB  
         1277 be left pending; without objection, it was so ordered.   
          
         Senator Brimer assumed the chair.   
          
         The chair laid out SB 838 and recognized the author, Senator  
         Armbrister, to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list.  Senator  
         Wentworth moved that SB 838 be reported favorably to the Senate  
         with the recommendation that it do pass and be printed.  The

         be recommended for placement on the Local & Uncontested

         The chair laid out SJR 29 and recognized the author, Senator

         Madla moved that SJR 29 be reported favorably to the Senate with  
         the recommendation that it do pass and be printed.  The motion  
         carried with a record vote of 5 ayes, 0 nay, 0 present not  
         voting, and 0 absent.  Senator Madla moved that the bill be  
         recommended for placement on the Local & Uncontested Calendar;  
         without objection, it was so ordered.   
          
         Senator Madla resumed the chair.   
          
         The chair laid out SB 821 and recognized Senator Gallegos, Jr.,  
         in the absence of the author, to explain the bill.  Senator  
         Gallegos, Jr. sent up a committee substitute; the chair  
         recognized Senator Gallegos, Jr. to explain the difference  
         between the committee substitute and the bill as filed.  Senator  
         Gallegos, Jr. moved adoption of the committee substitute;  
         without objection, it was so ordered.  Witnesses testifying and  
         registering on the bill are shown on the attached list.  Senator  
         Gallegos, Jr. moved that SB 821 do not pass but that CSSB 821 be  
         reported back to the Senate with the recommendation that it do  
         pass and be printed.  The motion carried with a record vote of 5  
         ayes, 0 nay, 0 present not voting, and 0 absent.  Senator  
         Gallegos, Jr. moved that the bill be recommended for placement  
         on the Local & Uncontested Calendar; without objection, it was  
         so ordered.   
         The chair laid out SB 1249 and recognized the author, Senator  
         Armbrister, to explain the bill.   
          
         The chair laid out SB 511 and recognized the author, Senator  
         Nelson, to explain the bill.

         Nelson, to explain the bill.

         attached list.   
          
         At 10:46 a.m. Senator Madla moved that the committee stand  
         recessed until 45 minutes after adjournment of the Senate;  
         without objection, it was so ordered.   
          
         At 3:05 p.m. the committee reconvened.  Testimony continued on  
         SBs: 1249, 511, 512 and 1085.  
  
         Senator Madla closed testimony on  SBs: 1249, 511, 512 and 1085. 
          
         The chair laid out CSSB 635 and recognized the author, Senator  
         Gallegos, Jr., to explain the bill.  Senator Gallegos, Jr. moved  
         that SB 635 do not pass but that CSSB 635 be reported back to  
         the Senate with the recommendation that it do pass and be  
         printed.  The motion carried with a record vote of 3 ayes, 0  
         nay, 0 present not voting, and 2 absent.  Witnesses testifying  
         and registering on the bill are shown on the attached list.   
         Senator Gallegos, Jr. moved that the bill be recommended for  
         placement on the Local & Uncontested Calendar; without  
         objection, it was so ordered.   
          
         Senator Deuell moved to be shown voting aye on SB 838 and SB  
         1696; without objection, it was so ordered.  Senator Brimer  
         moved to be shown voting aye on SB 726; without objection, it  
         was so ordered.  
          
         There being no further business, at 5:00 p.m. Senator Madla  
         moved that the Committee stand recessed subject to the call of  
         the chair.  Without objection, it was so ordered.
