Pursuant to a notice posted in accordance with Senate Rule
11.18, a public hearing of the Senate Committee on Education was
held on Tuesday, March 4, 2003, in the Capitol Extension, Room
E1.028, at Austin, Texas.

The chair called the meeting to order at 8:35 a.m. There being
a quorum present, the following business was transacted:
Senator West moved adoption of the minutes from the previous
hearings held on February 11, 2003, and February 25, 2003;
without objection, it was so ordered.
The chair referred SB 253, SB 315, SB 318, SB 334, SB 337, SB
437 and SB 503 to the Subcommittee on Higher Education for
consideration.
The chair laid out SB 335 and recognized the author, Senator
Wentworth, to explain the bill.
Witnesses testifying and registering on the bill are shown on
the attached list. The chair moved that the public testimony be
closed; without objection, it was so ordered.
The chair moved that SB 335 be left pending; without objection,
it was so ordered.
The chair laid out SB 186 and recognized the author, Senator
Janek, to explain the bill.
Senator Janek sent up a committee substitute; the chair
recognized Senator Janek to explain the difference between the
committee substitute and the bill as filed. Senator Janek moved
adoption of the committee substitute; without objection, it was
so ordered.
Witnesses testifying and registering on the bill are shown on
the attached list. The chair moved that the public testimony be
closed; without objection, it was so ordered.
Senator Janek moved that SB 186 do not pass but that CSSB 186 be
reported back to the Senate with the recommendation that it do
pass and be printed. The motion carried with a record vote of 8
ayes, 0 nay, 0 present not voting, and 1 absent.
At 9:38 a.m. Senator West assumed the chair.
The chair laid out SB 578 and recognized the author, Senator
Shapiro, to explain the bill.
Senator Shapiro sent up a committee substitute; the chair
recognized Senator Shapiro to explain the difference between the
committee substitute and the bill as filed. Senator Shapiro
moved adoption of the committee substitute; without objection,
it was so ordered.
Senator Shapiro sent up Committee Amendment 1 and moved
adoption; without objection, the amendment was adopted. Senator
Shapiro requested unanimous consent to incorporate the amendment
into the committee substitute; without objection, it was so
ordered. Senator Shapiro then moved that the new committee
substitute be adopted; without objection, it was so ordered.

closed; without objection, it was so ordered.
The chair moved that SB 578 be left pending to await a quorum;
without objection, it was so ordered.
At 9:50 a.m. Senator Shapiro resumed the chair.
The subcommittee report on SB 258 was laid out by Senator West.
Senator West was recognized to explain the subcommittee report
on SB 258. Senator West then moved adoption of the subcommittee
report; there being no objection, it was so ordered.

closed; without objection, it was so ordered.
The chair moved that SB 258 be left pending to await a quorum;
without objection, it was so ordered.

At 9:53 a.m. the chair moved that the committee stand recessed
to await arrival of a quorum; without objection, it was so
ordered. At 9:55 a.m. the committee reconvened.
The chair laid out SB 346 and recognized the author, Senator
Ogden, to explain the bill.
Senator Ogden sent up a committee substitute; the chair
recognized Senator Ogden to explain the difference between the
committee substitute and the bill as filed. Senator Ogden moved
adoption of the committee substitute; without objection, it was
so ordered.
Witnesses testifying and registering on the bill are shown on
the attached list. The chair moved that the public testimony be
closed; without objection, it was so ordered.
The chair moved that SB 346 be left pending to await a quorum;
without objection, it was so ordered.
At 10:14 a.m. the chair moved that the committee stand recessed
until 10:15 a.m; without objection, it was so ordered. At 10:16
a.m. the committee reconvened.
Upon arrival of a quorum, Senator West moved that SB 346 do not
pass but that CSSB 346 be reported back to the Senate with the
recommendation that it do pass and be printed. The motion
carried with a record vote of 9 ayes, 0 nay, 0 present not
voting, and 0 absent.
Upon arrival of a quorum, Senator West moved that SB 258 be
reported favorably to the Senate with the recommendation that it
do pass and be printed. The motion carried with a record vote
of 9 ayes, 0 nay, 0 present not voting, and 0 absent.
At 10:17 a.m. Senator West assumed the chair.
Upon arrival of a quorum, Senator Shapiro moved that SB 578 do
not pass but that CSSB 578 be reported back to the Senate with
the recommendation that it do pass and be printed. The motion
carried with a record vote of 9 ayes, 0 nay, 0 present not
voting, and 0 absent.
At 10:18 a.m. Senator Shapiro resumed the chair.
There being no further business, at 10:19 a.m. the chair moved
that the Committee stand recessed subject to the call of the
chair. Without objection, it was so ordered.
