Pursuant to a notice posted in accordance with Senate Rule
11.18, a public hearing of the Senate Committee on Education was
held on Tuesday, March 18, 2003, in the Capitol Extension, Room
E1.028, at Austin, Texas.

The chair called the meeting to order at 8:38 a.m. There being
a quorum present, the following business was transacted:
The chair called for a moment of silence to honor the late
Representative Irma Rangel.
There was no action taken for the following bill(s): SB 474 and
SB 744
The chair moved adoption of the minutes from the previous
hearings held on March 11, 2003, and March 13, 2003; without
objection, it was so ordered.
The following bills were referred to the Subcommittee on Higher
Education: SB 413, SB 415, SB 676 and SB 766.
The chair laid out SB 396 and recognized the author, Senator
Shapleigh, to explain the bill.
Senator Staples sent up a committee substitute; the chair
recognized Senator Shapleigh to explain the difference between
the committee substitute and the bill as filed. The chair moved
adoption of the committee substitute; without objection, it was
so ordered.
Witnesses testifying and registering on the bill are shown on
the attached list. The chair moved that the public testimony be
closed; without objection, it was so ordered.
The chair moved that SB 396 be left pending; without objection,
it was so ordered.
The chair laid out SB 741 and recognized the author, Senator Van
de Putte, to explain the bill.

The chair laid out SB 596 and recognized the author, Senator

The chair laid out SB 900 and recognized the author, Senator
Shapiro, to explain the bill.

closed; without objection, it was so ordered.
The chair moved that SB 900 be left pending to await a quorum;
without objection, it was so ordered.
At 9:55 a.m. Senator Shapiro resumed the chair.
At 9:55 a.m. the chair moved that the committee stand recessed
until 10:00 a.m; without objection, it was so ordered. At 10:00
a.m. the committee reconvened.
Upon arrival of a quorum, Senator Staples moved that SB 741 be
reported favorably to the Senate with the recommendation that it
do pass and be printed. The motion carried with a record vote
of 8 ayes, 0 nay, 0 present not voting, and 1 absent.
The subcommittee report on SB 253 was laid out by Senator
Shapiro. Senator Shapiro then moved adoption of the
subcommittee report; there being no objection, it was so

ordered.
Senator West moved that SB 253 be reported favorably to the
Senate with the recommendation that it do pass and be printed.
The motion carried with a record vote of 8 ayes, 0 nay, 0
present not voting, and 1 absent.
The subcommittee report on SB 437 was laid out by Senator
Shapiro. Senator Shapiro then moved adoption of the
subcommittee report; there being no objection, it was so
ordered.
Senator West moved that SB 437 be reported favorably to the
Senate with the recommendation that it do pass and be printed.
The motion carried with a record vote of 8 ayes, 0 nay, 0
present not voting, and 1 absent.
At 10:02 a.m. Senator West assumed the chair.
Upon arrival of a quorum, Senator Shapiro moved that SB 900 be
reported favorably to the Senate with the recommendation that it
do pass and be printed. The motion carried with a record vote
of 8 ayes, 0 nay, 0 present not voting, and 1 absent.
At 10:03 a.m. Senator Shapiro resumed the chair.
There being no further business, at 10:03 a.m. the chair moved
that the Committee stand recessed subject to the call of the
chair. Without objection, it was so ordered.
