         Pursuant to a notice posted in accordance with Senate Rule  
         11.18, a public hearing of the Senate Committee on Education was  
         held on Tuesday, April 8, 2003, in the Capitol Extension, Room  
         E1.028, at Austin, Texas.

         The chair called the meeting to order at 8:36 a.m.  There being  
         a quorum present, the following business was transacted:   
          
         Senator West moved adoption of the minutes from the previous  
         hearing held on April 3, 2003; without objection, it was so  
         ordered.   
          
         There was no action taken for the following bill(s): SB 1359, SB  
         1541 and SB 1542  
          
         The following bills were referred to the Subcommittee on Higher  
         Education:  SB 1319, SB 1367, SB 1368, SB 1476, and SB 1717. 
          
         The chair laid out SB 76 and recognized the author, Senator  
         Zaffirini, to explain the bill.   
          
         Senator Zaffirini sent up a committee substitute; the chair  
         recognized Senator Zaffirini to explain the difference between  
         the committee substitute and the bill as filed.  Senator  
         Zaffirini moved adoption of the committee substitute; without  
         objection, it was so ordered.   
          
         Witnesses testifying and registering on the bill are shown on  
         the attached list.  The chair moved that the public testimony be  
  
         closed; without objection, it was so ordered.   
          
         The chair moved that SB 76 be left pending; without objection,  
         it was so ordered.   
          
         The chair laid out SB 1510 and recognized the author, Senator  
         Zaffirini, to explain the bill.   
          
         Senator Zaffirini sent up a committee substitute; the chair  
         recognized Senator Zaffirini to explain the difference between  
         the committee substitute and the bill as filed.  Senator  
         Zaffirini moved adoption of the committee substitute; without  
         objection, it was so ordered.

         The chair moved that SB 1510 be left pending to await a quorum;  
         without objection, it was so ordered.

         At 9:45 a.m. Senator Van de Putte assumed the chair.   
          
         The chair laid out SB 1394 and recognized the author, Senator  
         Shapiro, to explain the bill.

         closed; without objection, it was so ordered.   
         Senator Van de Putte moved that SB 1394 be left pending to await  
         a quorum; without objection, it was so ordered.   
          
         The chair laid out SB 700 and recognized the author, Senator  
         Ogden, to explain the bill.   
          
         Senator Ogden sent up a committee substitute; the chair  
         recognized Senator Ogden to explain the difference between the  
         committee substitute and the bill as filed.  Senator Ogden moved  
         adoption of the committee substitute; without objection, it was  
         so ordered.

         Senator Van de Putte moved that SB 700 be left pending; without  
         objection, it was so ordered.  
          
         The chair laid out SB 1366 and recognized Senator Ogden, in the  
         absence of the author, to explain the bill.   
          
         Senator Ogden sent up a committee substitute; the chair  
         recognized Senator Ogden to explain the difference between the  
         committee substitute and the bill as filed.  Senator Ogden moved  
         adoption of the committee substitute; without objection, it was  
         so ordered.   
          
         Witnesses testifying and registering on the bill are shown on  
         the attached list.  The chair moved that the public testimony be  
         closed; without objection, it was so ordered.   
          
         At 10:38 a.m. Senator Shapiro resumed the chair.   
          
         The chair moved that SB 1366 be left pending to await a quorum;  
         without objection, it was so ordered.   
          
         At 10:40 a.m. the chair moved that the committee stand recessed  
         until 10:45 a.m.; without objection, it was so ordered.   At  
         9:48 a.m. the committee reconvened.   
          
         At 10:48 a.m. Senator West assumed the chair.   
          
         Upon arrival of a quorum, Senator Van de Putte moved that SB  
         1096 be reported favorably to the Senate with the recommendation  
         that it do pass and be printed.  The motion carried with a  
         record vote of 9 ayes, 0 nay, 0 present not voting, and 0  
         absent.   
          
         Upon arrival of a quorum, Senator Ogden moved that SB 1366 do  
         not pass but that CSSB 1366 be reported back to the Senate with  
         the recommendation that it do pass and be printed.  The motion  
         carried with a record vote of 9 ayes, 0 nay, 0 present not  
         voting, and 0 absent.    
          
         Upon arrival of a quorum, Senator Shapiro moved that SB 1394 be  
         reported favorably to the Senate with the recommendation that it  
         do pass and be printed.  The motion carried with a record vote  
         of 9 ayes, 0 nay, 0 present not voting, and 0 absent.   
          
         At 10:51 a.m. Senator Shapiro resumed the chair.   
          
         Upon arrival of a quorum, Senator Zaffirini moved that SB 1510  
         do not pass but that CSSB 1510 be reported back to the Senate  
         with the recommendation that it do pass and be printed.  The  
         motion carried with a record vote of 9 ayes, 0 nay, 0 present  
         not voting, and 0 absent.   
          
         At 10:52 a.m. Senator West assumed the chair.   
          
         SB 933 by Senator Shapiro was previously laid out in Committee                                                                             
         on April 1, 2003.  Senator Shapiro moved that SB 933 do not pass  
         but that CSSB 933 be reported back to the Senate with the  
         recommendation that it do pass and be printed.  The motion  
         carried with a record vote of 5 ayes, 3 nays, 0 present not  
         voting, and 1 absent.   
          
         At 10:54 a.m. Senator Shapiro assumed the chair.   
          
         There being no further business, at 10:55 a.m. the chair moved  
         that the Committee stand recessed subject to the call of the  
         chair.  Without objection, it was so ordered.
