Pursuant to a notice posted in accordance with Senate Rule
11.18, a public hearing of the Senate Committee on Education was
held on Tuesday, April 15, 2003, in the Capitol Extension, Room
E1.028, at Austin, Texas.

The chair called the meeting to order at 8:37 a.m. There being
a quorum present, the following business was transacted:
Senator Zaffirini moved adoption of the minutes from the
previous hearings held on April 8, 2003, and April 10, 2003;
without objection, it was so ordered.
The chair laid out SB 671 and recognized the author, Senator
Staples, to explain the bill.
Witnesses testifying and registering on the bill are shown on
the attached list. The chair moved that the public testimony be
closed; without objection, it was so ordered.
The chair moved that SB 671 be left pending; without objection,
it was so ordered.
The chair laid out SB 682 and SJR 32 and recognized the author,
Senator Janek, to explain the bills.
Witnesses testifying and registering on the bills are shown on
the attached list. The chair moved that the public testimony be
closed; without objection, it was so ordered.
The chair moved that SB 682 and SJR 32 be left pending; without
objection, it was so ordered.
The chair laid out SB 352 and recognized the author, Senator
Wentworth, to explain the bill.

The chair moved that the public testimony be closed; without
objection, it was so ordered.
The chair moved that SB 352 be left pending; without objection,
it was so ordered.
At 10:54 a.m. the chair moved that the committee stand recessed
until thirty minutes after adjournment of the Senate; without
objection, it was so ordered. At 3:17 p.m. the committee
reconvened.
The chair referred the following bills to the Subcommittee on
Higher Education: SB 462,
SB 1127, and SJR 59.
The chair laid out SB 1138 and recognized the author, Senator
Van de Putte, to explain the bill.
At 3:24 p.m. Senator West assumed the chair.
Witnesses testifying and registering on the bill are shown on
the attached list. The chair moved that the public testimony be
closed; without objection, it was so ordered.
Senator West moved that SB 1138 be left pending; without
objection, it was so ordered.
At 3:29 p.m. Senator Van de Putte assumed the chair.
The chair laid out SB 687 and recognized the author, Senator
West, to explain the bill.

closed; without objection, it was so ordered.
Senator Van de Putte moved that SB 687 be left pending to await
a quorum; without objection, it was so ordered.
At 3:36 p.m. Senator West assumed the chair.
The chair laid out SB 76 and recognized the author, Senator
Zaffirini, to explain the bill.
Senator Van de Putte moved to reconsider the motion by which the
previous Committee Substitute to SB 76 was adopted, without
objection it was so ordered.
Senator Zaffirini sent up a new committee substitute; the chair
recognized Senator Zaffirini to explain the difference between
the committee substitute and the bill as filed. Senator
Zaffirini moved adoption of the committee substitute; without
objection, it was so ordered.

At 3:46 p.m. Senator Van de Putte assumed the chair.
The chair moved that the public testimony be closed; without
objection, it was so ordered.
Senator Van de Putte moved that SB 76 be left pending to await a
quorum; without objection, it was so ordered.
At 3:50 p.m. Senator Van de Putte moved that the Committee stand
at ease, without objection it was so ordered. At 4:03 p.m. the
Committee reconvened.
The chair laid out SB 1542 and SB 1541 and recognized the
author, Senator Shapiro, to explain the bills.
Senator Shapiro sent up a committee substitute to SB 1542 which
incorporates SB 1541 into SB 1542; the chair recognized Senator
Shapiro to explain the difference between the committee
substitute and the bill as filed. Senator Shapiro moved
adoption of the committee substitute; without objection, it was
so ordered.

the attached list. The chair moved that the public testimony be
closed; without objection, it was so ordered.
Senator Van de Putte moved that SB 1541 be left pending; without
objection, it was so ordered.
Senator Van de Putte moved that SB 1542 be left pending to await
a quorum; without objection, it was so ordered.
At 5:44 p.m. Senator Shapiro resumed the chair.
Upon arrival of a quorum, Senator West moved that SB 687 be
reported favorably to the Senate with the recommendation that it
do pass and be printed. The motion carried with a record vote
of 9 ayes, 0 nay, 0 present not voting, and 0 absent.
Upon arrival of a quorum, Senator Janek moved that SB 76 do not
pass but that CSSB 76 be reported back to the Senate with the
recommendation that it do pass and be printed. The motion
carried with a record vote of 9 ayes, 0 nay, 0 present not
voting, and 0 absent.
The subcommittee report on SB 334 was laid out by Senator
Shapiro, Senator West then moved adoption of the subcommittee
report; there being no objection, it was so ordered.
Senator West moved that SB 334 do not pass but that CSSB 334 be
reported back to the Senate with the recommendation that it do
pass and be printed. The motion carried with a record vote of 9
ayes, 0 nay, 0 present not voting, and 0 absent.
Senator Staples moved that the bill be recommended for placement
on the Local & Uncontested Calendar; without objection, it was
so ordered.
At 5:50 p.m. Senator West assumed the chair.
Senator Ogden sent up Committee Amendment 1 to CSSB 1542 and
moved adoption; without objection, the amendment was adopted.
Senator Ogden requested unanimous consent to incorporate the
amendment into the committee substitute; without objection, it
was so ordered. Senator Shapiro then moved that the new
committee substitute be adopted; without objection, it was so
ordered.
Senator Shapiro moved that SB 1542 do not pass but that CSSB
1542 be reported back to the Senate with the recommendation that
it do pass and be printed. The motion carried with a record
vote of 8 ayes, 0 nay, 0 present not voting, and 1 absent.
At 6:13 p.m. Senator Shapiro resumed the chair.
There being no further business, at 6:14 p.m. Senator Shapiro
moved that the Committee stand recessed subject to the call of
the chair. Without objection, it was so ordered.
