Pursuant to a notice posted in accordance with Senate Rule
11.18, a public hearing of the Senate Committee on Education was
held on Thursday, May 8, 2003, in the Capitol Extension, Room
E1.012, at Austin, Texas.

The chair called the meeting to order at 8:36 a.m. There being
a quorum present, the following business was transacted:
There was no action taken for the following bill(s): SB 1292, SB
1778 and SB 1908
The chair laid out SB 968 and recognized the author, Senator
Shapleigh, to explain the bill.
Witnesses testifying and registering on the bill are shown on
the attached list. The chair moved that the public testimony be
closed; without objection, it was so ordered.
The chair moved that SB 968 be left pending to await a quorum;
without objection, it was so ordered.
The chair laid out SB 1181 and recognized the author, Senator
West, to explain the bill.
Senator West sent up a committee substitute; the chair
recognized Senator West to explain the difference between the
committee substitute and the bill as filed. Senator West moved
adoption of the committee substitute; without objection, it was
so ordered.

The chair moved that SB 1181 be left pending to await a quorum;
without objection, it was so ordered.
The subcommittee report on SB 1127 was laid out by Senator
Shapiro. Senator Van de Putte was recognized to explain the
subcommittee report on SB 1127. Senator Van de Putte then moved
adoption of the subcommittee report; there being no objection,
it was so ordered.

The chair laid out SB 1732 and recognized Senator Van de Putte,
in the absence of the author, to explain the bill.
Senator Van de Putte sent up a committee substitute; the chair
recognized Senator Van de Putte to explain the difference
between the committee substitute and the bill as filed.

the attached list. The chair moved that the public testimony be
closed; without objection, it was so ordered.
The chair moved that SB 1732 be left pending to await a quorum;
without objection, it was so ordered.
Previously, Senator Van de Putte sent up 2 committee amendments
and a committee substitute to SB 722, all of which were adopted;
without objection. Senator Van de Putte sent up Committee
Amendment 3 and moved adoption; without objection, the amendment
was adopted.
Senator Van de Putte requested unanimous consent to incorporate
amendments into the committee substitute; without objection, it
was so ordered. Senator Van de Putte then moved that the new
committee substitute be adopted; without objection, it was so
ordered.
At 9:14 a.m. the chair moved that the Committee stand at ease;
without objection it was so ordered. At 9:40 a.m. the chair
called the Committee back to order.
Senator West sent up Committee Amendment 1 to CSSB 1181 and
moved adoption; without objection, the amendment was adopted.
Senator West sent up Committee Amendment 2 to CSSB 1181 and
moved adoption; without objection, the amendment was adopted.
Senator West requested unanimous consent to incorporate
amendments into the committee substitute; without objection, it
was so ordered. Senator West then moved that the new committee
substitute be adopted; without objection, it was so ordered.
Upon arrival of a quorum, Senator West moved that SB 1181 do not
pass but that CSSB 1181 be reported back to the Senate with the
recommendation that it do pass and be printed. The motion
carried with a record vote of 6 ayes, 0 nay, 0 present not
voting, and 3 absent.
Upon arrival of a quorum, Senator Janek moved that SB 968 be
reported favorably to the Senate with the recommendation that it
do pass and be printed. The motion carried with a record vote
of 6 ayes, 0 nay, 0 present not voting, and 3 absent.
Senator Janek moved that the bill be recommended for placement
on the Local & Uncontested Calendar; without objection, it was
so ordered.
Senator Van de Putte moved adoption of the committee substitute
for SB 1732; without objection, it was so ordered.
Upon arrival of a quorum, Senator Van de Putte moved that SB
1732 do not pass but that CSSB 1732 be reported back to the
Senate with the recommendation that it do pass and be printed.
The motion carried with a record vote of 7 ayes, 0 nay, 0
present not voting, and 2 absent.
Senator West moved that SB 722 do not pass but that CSSB 722 be
reported back to the Senate with the recommendation that it do
pass and be printed. The motion carried with a record vote of 7
ayes, 0 nay, 0 present not voting, and 2 absent.
The subcommittee report on SB 413 was laid out by Senator
Shapiro. Senator West was recognized to explain the
subcommittee report on SB 413. Senator West then moved adoption
of the subcommittee report; there being no objection, it was so
ordered.
Senator West moved that SB 413 be reported favorably to the
Senate with the recommendation that it do pass and be printed.
The motion carried with a record vote of 7 ayes, 0 nay, 0
present not voting, and 2 absent.
Senator West moved that the bill be recommended for placement on
the Local & Uncontested Calendar; without objection, it was so
ordered.
The subcommittee report on SB 503 was laid out by Senator West.
Senator West was recognized to explain the subcommittee report
on SB 503. Senator Averitt then moved adoption of the
subcommittee report; there being no objection, it was so
ordered.
Senator Averitt moved that SB 503 be reported favorably to the
Senate with the recommendation that it do pass and be printed.
The motion carried with a record vote of 7 ayes, 0 nay, 0
present not voting, and 2 absent.
Senator Averitt moved that the bill be recommended for placement
on the Local & Uncontested Calendar; without objection, it was
so ordered.
Upon arrival of a quorum, Senator West moved that SB 1127 do not
pass but that CSSB 1127 be reported back to the Senate with the
recommendation that it do pass and be printed. The motion
carried with a record vote of 7 ayes, 0 nay, 0 present not
voting, and 2 absent.
Senator Van de Putte moved that the bill be recommended for
placement on the Local & Uncontested Calendar; without
objection, it was so ordered.
There being no further business, at 9:51 a.m. the chair moved
that the Committee stand recessed subject to the call of the
chair. Without objection, it was so ordered.
