Pursuant to a notice posted in accordance with Senate Rule
11.18, a public hearing of the Senate Committee on Education was
held on Tuesday, May 13, 2003, in the Capitol Extension, Room
E1.028, at Austin, Texas.

The chair called the meeting to order at 8:36 a.m. There being
a quorum present, the following business was transacted:
Senator Williams moved adoption of the minutes from the previous
hearings held on May 6, 2003, May 8, 2003, and May 8, 2003 at
Senator Shapiro's Desk; without objection, it was so ordered.
There was no action taken for the following bill(s): SB 1292, SB
1747, HB 1441, HB 1649, and HB 1650.
The chair laid out HB 1339 and recognized the Senate sponsor,
Senator Williams, to explain the bill.
Witnesses testifying and registering on the bill are shown on
the attached list. The chair moved that the public testimony be
closed; without objection, it was so ordered.
Senator Janek moved that HB 1339 be reported favorably to the
Senate with the recommendation that it do pass and be printed.
The motion carried with a record vote of 6 ayes, 0 nay, 0
present not voting, and 3 absent.
Senator Janek moved that the bill be recommended for placement
on the Local & Uncontested Calendar; without objection, it was
so ordered.
The chair laid out HB 2061 and recognized the Senate sponsor,

At 2:40 p.m. Senator Van de Putte assumed the chair.
Senator Van de Putte moved that the public testimony be closed
on HB 2169; without objection, it was so ordered.

objection, it was so ordered.

Senator Shapiro, to explain the bill.

The subcommittee report on SB 26 was laid out by Senator
Shapiro. Senator West was recognized to explain the
subcommittee report on SB 26. Senator West then moved adoption
of the subcommittee report; there being no objection, it was so
ordered.
Senator West moved that SB 26 do not pass but that CSSB 26 be
reported back to the Senate with the recommendation that it do
pass and be printed. The motion carried with a record vote of 7
ayes, 0 nay, 0 present not voting, and 2 absent.
Senator West moved that the bill be recommended for placement on
the Local & Uncontested Calendar; without objection, it was so
ordered.
The subcommittee report on SB 1200 was laid out by Senator
Shapiro. Senator West was recognized to explain the
subcommittee report on SB 1200. Senator Shapiro then moved
adoption of the subcommittee report; there being no objection,
it was so ordered.
Senator West moved that SB 1200, as amended, be reported back to
the Senate with the recommendation that it do pass and be
printed. The motion carried with a record vote of 6 ayes, 0
nay, 0 present not voting, and 3 absent.
The subcommittee report on SB 1367 was laid out by Senator
Shapiro. Senator West was recognized to explain the
subcommittee report on SB 1367. Senator Shapiro then moved
adoption of the subcommittee report; there being no objection,
it was so ordered.
Senator West moved that SB 1367 do not pass but that CSSB 1367
be reported back to the Senate with the recommendation that it
do pass and be printed. The motion carried with a record vote
of 8 ayes, 0 nay, 0 present not voting, and 1 absent.
Senator West moved that the bill be recommended for placement on
the Local & Uncontested Calendar; without objection, it was so
ordered.
The subcommittee report on SB 1546 was laid out by Senator
Shapiro. Senator West was recognized to explain the
subcommittee report on SB 1546. Senator Shapiro then moved
adoption of the subcommittee report; there being no objection,
it was so ordered.
Senator West moved that SB 1546 do not pass but that CSSB 1546
be reported back to the Senate with the recommendation that it
do pass and be printed. The motion carried with a record vote
of 8 ayes, 0 nay, 0 present not voting, and 1 absent.
Senator West moved that the bill be recommended for placement on
the Local & Uncontested Calendar; without objection, it was so
ordered.
The chair recalled HB 944 by King, which was previously referred
to the Subcommittee on Higher Education, back to the full
Committee.
There being no further business, at 3:13 p.m. the chair moved
that the Committee stand recessed subject to the call of the
chair. Without objection, it was so ordered.
