         Pursuant to a notice posted in accordance with Senate Rule  
         11.18, a public hearing of the Senate Committee on Education was  
         held on Thursday, May 22, 2003, in the Capitol Extension, Room  
         E1.012, at Austin, Texas.

         The chair called the meeting to order at 8:40 a.m.  There being  
         a quorum present, the following business was transacted:   
          
         The chair laid out HB 469 and recognized the Senate sponsor,  
         Senator Deuell, to explain the bill.  
          
         Senator Shapiro moved that HB 469 be left pending to await a  
         quorum; without objection, it was so ordered.  
          
         The chair laid out HB 1363 and recognized the Senate sponsor,  
         Senator Estes, to explain the bill.   
          
         Witnesses testifying and registering on the bill are shown on  
         the attached list.  The chair moved that the public testimony be  
         closed; without objection, it was so ordered.  
          
         Senator Shapiro moved that HB 1363 be left pending to await a  
         quorum; without objection, it was so ordered.

         Senator Shapiro moved that HB 1050 be left pending to await a  
         quorum; without objection, it was so ordered.  
          
         The chair laid out HB 552 and recognized Senator Van de Putte,  
         in the absence of the Senate sponsor, to explain the bill.

         between the committee substitute and the bill as filed.

         without objection, the amendment was adopted.

         do pass and be printed.  The motion carried with a record vote

         Senator West moved that the bill be recommended for placement on

         ordered.   
          
         Upon arrival of a quorum, Senator Janek moved that HB 469 be  
         reported favorably to the Senate with the recommendation that it  
         do pass and be printed.  The motion carried with a record vote  
         of 6 ayes, 0 nay, 0 present not voting, and 3 absent.   
          
         Senator Janek moved that the bill be recommended for placement  
         on the Local & Uncontested Calendar; without objection, it was  
         so ordered.   
          
         Upon arrival of a quorum, Senator Averitt moved that HB 552 be  
         reported favorably to the Senate with the recommendation that it  
         do pass and be printed.  The motion carried with a record vote  
         of 6 ayes, 0 nay, 0 present not voting, and 3 absent.   
          
         Senator Janek moved that the bill be recommended for placement  
         on the Local & Uncontested Calendar; without objection, it was  
         so ordered.   
          
         Upon arrival of a quorum, Senator Van de Putte moved that HB  
         1050 be reported favorably to the Senate with the recommendation  
         that it do pass and be printed.  The motion carried with a  
         record vote of 6 ayes, 0 nay, 0 present not voting, and 3  
         absent.   
          
         Senator Van de Putte moved that the bill be recommended for  
         placement on the Local & Uncontested Calendar; without  
         objection, it was so ordered.   
          
         Upon arrival of a quorum, Senator Janek moved that HB 1146, as  
         amended, be reported back to the Senate with the recommendation  
         that it do pass and be printed.  The motion carried with a

         Senator Van de Putte moved adoption of Committee Amendment 1 to  
         HB 1202; without objection, the amendment was adopted.   
          
         Upon arrival of a quorum, Senator Van de Putte moved that HB  
         1202, as amended, be reported back to the Senate with the  
         recommendation that it do pass and be printed.  The motion  
         carried with a record vote of 6 ayes, 0 nay, 0 present not  
         voting, and 3 absent.

         objection, it was so ordered.   
          
         Senator Janek sent up a committee substitute to HB 1363; the  
         chair recognized Senator Estes to explain the difference between  
         the committee substitute and the bill as filed.  Senator Janek

         Senator West moved adoption of Committee Amendment 1 to HB 1621;  
         without objection, the amendment was adopted.   
          
         Upon arrival of a quorum, Senator West moved that HB 1621, as  
         amended, be reported back to the Senate with the recommendation  
         that it do pass and be printed.  The motion carried with a  
         record vote of 6 ayes, 0 nay, 0 present not voting, and 3  
         absent.

         The subcommittee report on HB 1420 was laid out by Senator West.   
         Senator West was recognized to explain the subcommittee report  
         on HB 1420.  Senator West then moved adoption of the  
         subcommittee report; there being no objection, it was so  
         ordered.   
          
         Senator West moved that HB 1420 do not pass but that CSHB 1420  
         be reported back to the Senate with the recommendation that it  
         do pass and be printed.  The motion carried with a record vote

         be reported back to the Senate with the recommendation that it

         on HB 3425.  Senator West then moved adoption of the

         ordered.   
          
         Previously, Senator Janek sent up Committee Amendment 1 and it  
         was adopted.  Senator West sent up Committee Amendment 2 and  
         moved adoption; without objection, the amendment was adopted.   
          
         Senator West moved that HB 3425, as amended, be reported back to  
         the Senate with the recommendation that it do pass and be
